Victor Peters has devoted his nearly 40 year legal career to the representation of the insurance industry. Victor’s practice primarily involves the representation of his insurance clients on a nation-wide basis as coverage counsel, counseling clients on proper claims handling, and in coverage litigation in both state and federal court. His practice concentration has primarily been in the professional liability sector of the insurance industry in a wide range of professional liability areas, including directors and officers, employment practices, fiduciary liability, financial institutions errors and omissions, for-profit and non-profit errors and omissions, crime coverage, and complex commercial general liability matters. In addition to claims handling and litigation activities, his representation includes product development and policy drafting and endorsement drafting designed to address unique underwriting needs. Victor also regularly counsels his clients on proper claims handling and bad faith avoidance techniques. The combination of his extensive legal experience in the professional liability area and his practical approach to dispute resolution has permitted Victor to provide his insurance clients with a sophisticated and high level practice in an efficient and cost sensitive fashion.
Representative Experience
Counseling insurers in responding to FDIC claims against directors and officers of multiple closed banks in both the 1980’s and 1990’s and today;
Participation in hundreds of mediations designed to resolve disputes short of protracted and expensive litigation;
Extensive experience in handling matters in Multi-District Litigation, including price fixing, financial institution fraud, fuel price manipulation, and, healthcare consumer fraud;
Counseling clients in the investigation and adjustment of complex claims, including securities class actions, derivative matters, antitrust, RICO, and, patent infringement;
Adjustment of hundreds of employment actions, including FLSA class actions, Fair Labor Standard Act matters, PAGA actions, and, collective bargaining disputes;
Investigation and adjustment of multiple multi-million dollar Crime coverage claims with particular emphasis on employee dishonesty losses;
Representation of clients throughout the United States in coverage litigation and in rescission actions on professional liability policies, including multiple arguments before the 7th Circuit Court of Appeals;
Extensive experience in the evaluation and resolution of complex financial institution claims, including participation loans, lender liability and consumer fraud cases, identity theft, and, Ponzi scheme losses.
