We represent insurers in connection with high profile, high-dollar value mass tort litigation arising out of environmental disasters, defective products and toxic torts.  In addition to these high exposure cases, our attorneys provide coverage opinions and loss analysis in connection with individual claims submitted under general liability, umbrella, and excess policies.

Employment Practices Litigation

We represent both domestic and international insurers in the resolution of EPL claims, including high-profile class actions, individual lawsuits, and administrative claims. These cases involve discrimination pertaining to race, gender, disability, age, national origin, and equal pay; constructive and retaliatory discharge; harassment in the workplace; wage-and-hour violation claims under state and federal law; whistleblower actions; wrongful termination or treatment, FMLA claims, invasion of privacy, erroneous job description, and third-party claim.

Fiduciary Liability

We represent and counsel insurers in connection with complex claims brought against administrators, fiduciaries and trustees of Employer sponsored health, pension and retirement benefit plans. We routinely counsel and protect insurers in connection with ERISA related matters including ERISA Stock Drop cases; Department of Labor Investigations and “Tag-along” ERISA actions that often accompany securities fraud claims.

Fidelity Bonds

Peters & Nye provides comprehensive services relating to claims arising under Financial Institution bonds, Fidelity Bonds, Securities Broker/Dealer Bonds, Mortgage Broker/Banker Bonds, and Commercial Crime Policies.  We have extensive nationwide experience handling cases involving employee dishonesty, computer crime, lending losses, theft, fraud, Ponzi schemes, forgery, and counterfeiting.  We also counsel clients in policy drafting and underwriting issues.

Professional Liability

We have extensive experience representing and counseling insurers regarding claims brought against professionals for negligence in the performance of their services. We provide clients assistance with timely, effective claim resolution strategies that properly take into account defenses available both to the carriers and their insureds. We advise and assist defense counsel in difficult cases and frequently assist defense counsel in handling settlement negotiations.
