Peters & Nye LLP (“the Firm,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information of visitors to our website, petersnye.com (the “Site”), and individuals who communicate with us by phone, text message, or email.   • Text Messages: If you initiate contact with the Firm by calling or texting one of our office phone lines, or if you provide your mobile number to us directly in the course of a client engagement, we may use that number to send you administrative and case-related text messages as described in our Terms of Service / SMS Terms.

1.2 Information Collected Automatically

  • Analytics Data: Like most websites, we may use analytics tools (e.g., Google Analytics or similar services) that automatically collect information such as your IP address, browser type, device type, pages visited, referring URLs, and approximate geographic location, for the purpose of understanding site usage and improving our Site.
  • Cookies: Our Site may use cookies and similar tracking technologies to support Site functionality and analytics. You can control cookie preferences through your browser settings.
  • Do Not Track Signals: Our Site currently does not alter its data collection practices in response to “Do Not Track” signals transmitted by web browsers.

1.3 Information We Do Not Collect via the Website

Our Site does not include a contact form and does not collect your name, email address, phone number, or any other personal information through a web-based submission. The only way to reach the Firm through the Site is by calling the office number listed on our Contact page. Any personal information you provide during that call, or in later written correspondence (such as an engagement letter or intake documentation), is collected directly by the Firm and is not automatically captured by the Site.

2. How We Use Your Information

We use the information we collect to:

  • Respond to and follow up on inquiries from visitors who call our office directly;
  • Communicate with current clients, prospective clients, opposing counsel, and vendors regarding legal matters, case status, scheduling, and administrative matters;
  • Send text messages related to case updates, meeting coordination, appointment reminders, and administrative notifications to individuals who have directly initiated contact with the Firm via phone or text, or who have provided their mobile number through direct engagement correspondence;
  • Maintain and improve our Site through aggregated analytics; and
  • Comply with our professional, ethical, and legal obligations as a law firm.

3. Mobile Information and SMS/Text Messaging Data — No Sale or Sharing for Marketing Purposes

This section addresses the collection, use, and sharing of mobile opt-in and mobile phone number data specifically.

Peters & Nye LLP does not sell, rent, trade, lease, or otherwise disclose mobile phone numbers, SMS/text messaging opt-in status, or any other mobile subscriber information collected in connection with text messaging communications to any third party or affiliate for their marketing or promotional purposes.

Specifically:

No mobile information will be shared or sold to third parties or affiliates for marketing or promotional purposes. This includes text messaging originator opt-in data and consent; this information will not be shared with any third parties for marketing purposes.

Mobile information may be shared only with:

  • Service providers who perform functions on our behalf strictly necessary to deliver text messages (e.g., our SMS/telephony platform provider or carrier), and who are contractually prohibited from using such information for their own marketing purposes; or
  • As required by law, court order, or valid legal process.

This carve-out applies regardless of any other data-sharing provision described elsewhere in this Policy or in any other Firm document.

4. How We Share Information Generally

Apart from the mobile information restrictions in Section 3 above, we may share limited information with:

  • Trusted vendors who provide website hosting, analytics, or IT services under confidentiality obligations;
  • Co-counsel, experts, or other parties as necessary and appropriate to represent clients in connection with a legal matter, consistent with our professional and ethical obligations; and
  • Government authorities or other parties when required by law, subpoena, or court order.

We do not sell personal information collected through the Site to third parties.

5. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We retain personal information, including mobile contact information used for text messaging, for as long as necessary to fulfill the purposes described in this Policy, to maintain client files consistent with our professional obligations, and to comply with applicable law.

7. Your Choices

  • Analytics/Cookies: You may adjust your browser settings to limit or block cookies. Doing so may affect certain Site functionality.
  • Email Communications: You may contact us directly to request removal from any non-essential email communications.

8. Children’s Privacy

Our Site and services are not directed to individuals under the age of 18, and we do not knowingly collect personal information from children.
